HR Matters: Important leave reminders

There are times when you may need to focus on your own serious health condition or to care for a family member.  The Leave Management Team is available to help you understand your options.

The Family Medical Leave Act (FMLA) provides eligible employees up to 12 work weeks of unpaid leave per year for qualifying reasons.  To be eligible, the employee must have worked for the District for at least 12 months and have worked a minimum of 1,250 hours in the 12 months prior to the first day of the employee’s leave of absence.

FMLA may be used for the following reasons:

  • The employee’s own serious health condition
  • Birth of a child, or placement of a child through adoption or foster care
  • To care for the employee’s spouse, parent, or child under the age of 18 with serious health condition
  • Qualifying exigency related to the deployment of a spouse, adult child or parent called to active duty for a covered military activity.

Family medical leave (FML) may be used either as a continuous leave or as an intermittent leave (i.e., for periodic treatment and flare-ups). 

What if you don’t qualify for FML?  You may qualify for another type of leave.

Temporary Disability Leave (TDL) provides a maximum of 180 calendar days of unpaid leave for full-time employees whose position requires certification by the State Board of Education (SBEC), including SBEC-certified paraprofessionals.

Personal Illness Leave (PI) provides a maximum of 180 calendar days of unpaid leave for full-time employees whose position does not require educator certification by the State Board of Education, or for permanent part-time employees.

Temporary Disability Leave and Personal Illness Leave may only be used for a continuous leave of absence for the employee’s own serious health condition.  It may not be used as intermittent leave, or to care for a spouse, child, or parent.

A serious medical condition is defined as inpatient or continuous care or treatment, or incapacitation and inability to work or perform regular daily activities.

All types of leave are unpaid unless the employee has discretionary, sick or vacation leave available to use.  All types of leave run concurrently, up to the maximum 180 days.
