Active Duty Service Member and Peace Officer Transfer

HB 1959 and HB 2892 provide for the transfer, at the request of an active duty service member or peace officer, of a student they are the parent of or standing in parental relationship with the child, to the district or campus selected by the qualifying service member or peace officer.

Eligibility The parent or person in a parental relationship with the child requesting the transfer shall provide valid documentation indicating they are either an active duty servicemember or peace officer. All other required documentation is due at the time of registration.

Qualifying transfer requestors may reside:

  • In-district; or
  • Out-of-district(must reside within an adjoining school district)
    • Comal ISD
    • Northside ISD
    • Alamo Heights ISD
    • Ft. Sam Houston ISD
    • Judson ISD
    • Boerne ISD
    • San Antonio ISD

We encourage the parent or person in a parental relationship to follow the link provided in the transfer confirmation email to complete their child’s registration.

Transfer Process

  1. Go to the School Choice Application
  2. Select NEISD Enrolled Student or Non-NEISD Enrolled Student
  3. Once at the application page
  4. Complete the application
  5. Indicate that you are requesting a service member or peace officer transfer.
  6. Once the application is submitted, you will receive a confirmation email of your request.
  7. The request will be processed and you will be notified to contact the campus to complete your child’s enrollment and provide necessary documentation related to your transfer.

Required Documentation

Service Member
  •  A service member is an active duty service member of the United States or Texas National Guard armed forces.
  • Present a valid Texas National Guard ID or Department of Defense photo ID
Peace Officer 
  • "Peace officer" means a person elected, employed, or appointed as a peace officer under Article 2.12, Code of Criminal Procedure, or other law. (Until 1.1.2025); and "Peace officer" means a person elected, employed, or appointed as a peace officer under Article 2A.001, Code of Criminal Procedure, or other law. (After 1.1.205).

  • The transfer requestor must present their current and valid peace officer credentials issued by their agency.

FAQs

UIL

For University Interscholastic League (UIL) purposes, students must meet all UIL criteria. Students approved for any intra-district transfer should contact the Executive Director of Athletics to determine the implications and required forms to be completed before participating in any UIL event.

Transportation

Transportation is not provided. 
  • What if the step-parent is the service member or peace officer?
    • If the person in parental relationship of the student qualifies as a service member or peace officer, they can request the transfer.
  • Do I have to request a transfer for each year?
    • Yes, they must submit a new application each year to certify the active status of service members and peace officers.
  • Can I request a transfer more than once per school year?
    • Yes, however, it is in the best interest of the student to remain enrolled at one school for the duration of the school year. We understand that circumstances may change and encourage you to work with the school to determine the best learning environment for your child.
  • Can I select any school?
    • Yes, the eligible parent or person standing in parental relationship of the student may select any school appropriate for their child’s grade level. However, magnet programs and specialty schools are not eligible within this transfer process, and the magnet program/specialty school application process must be followed.
  • Is there a window for transfer requests?
    • No, transfer requests may be made anytime during the school year. Transfer requests for the next school year will be available in December of the current school year. 
  • Is my child eligible to transfer to a Pre-K program?
    • Yes, if your child qualifies for Pre-K by meeting at least one of the Texas Pre-K qualifying criteria. If your child is a non-qualifying student, they are eligible to attend Pre-K at one of our designated campuses as a tuition student.
      • To see if your child is eligible for Pre-K, please check the requirements here: Pre-K Eligibility (Note that residency in North East ISD is not required for this type of transfer);
    • After a student completes Pre-K, they will continue at the selected campus for the remainder of the school level unless another school is requested. 
  • What if my child receives special education services?
    • Students who qualify to receive special education services are eligible for transfer. School availability is based on a campus's ability to implement a student’s IEP.
